We are very fortunate to have an expert like Attorney Shon Cook with us to help explain the in's and out's of the legal system and how it works on the Muskegon Channel.  This week Shon is discussing attorney client privilege and how that dynamic works.

 

An attorney is legally bound to ethics through very strict guidelines and the policing of the profession is done from within and it carries a lot of weight.  Remaining on the "good side" of the Bar is paramount and keeping the reputation among clients is huge too, because people talk.  That's the surface level of things.  A deeper look gets into the attorney client privilege.  Much like the confidentiality of a physician or a priest, what you confide in an attorney can go no further without written consent.  Even if a client is guilty of something in a criminal case or in a civil case where someone might tell an attorney something they don't want others to know, once it's said, it's locked up and cannot be repeated.  This carries beyond the court as well.  Even in a casual conversation an attorney has to remain vigilant about what's said around anyone they are engaged with.  An attorney will also ask for a written agreement at times in advance to begin this attorney client relationship.  If it seems that the fist phone call or email to a lawyer is met with a level of pause, this is probably the case.
