It might not be one of the more sizzling headlines of a Saturdays With Shon feature, but it's probably one that you'd find yourself using compared to some of the more specialized segments deeper in the legal world we've delved.
By definition - "A subpoena is a legal document that commands a person or entity to testify as a witness at a specified time and place (at a deposition, trial, or other hearing), and/or to produce documents or other tangible objects in a legal proceeding. Subpoenas are time-sensitive with court-imposed deadlines." So that seems to be that right? But it's in the delivery and response to that subpoena that the intricacies of the legal world unfold and it comes down to you needing to decide if you think that self service, self service with an assist or if using the help of a lawyer if what's in order.
A subpoena is possible as a DIY project, however there are still somethings that you'd have to involve the assistance of a judge for in issuing one yourself. You may need a process server as well. With the help of an attorney, they can issue a subpoena and make things move, however there are requirements on either the receivers end as well that need to be met when it comes to response, action or the possibility of objection. Like many other areas in the legal world, it can be a lot to understand and depending on the issue at hand, it's probably money best spent on someone who can help you navigate the decisions.
Shon breaks it all down for ya. Andy tries to follow along and while he's know more for his charm than deep thoughts on legalities, he's got a few concerns and thoughts that come along with the topic of subpoenas. Take a listen.
If you've ever been served one, you know that it's a weird feeling. If it's a day to day thing for you, well maybe not so much be the average person doesn't have that much exposure to the courts and court system of operations.
